At Crater, your privacy and data integrity are our top priorities. We are committed to transparency in how we handle and use your data to provide the best possible user experience. This Privacy Policy details the steps we take to deliver our service to you while protecting your data.
This Statement of Privacy applies to Crater Email Client and Crater LLC, and governs both entities’s collection and usage of user-provided data. For the purposes of this Privacy Policy, unless otherwise noted, all references to Crater LLC include crater.pro, crater.email, and Crater. The Crater application is an email-based application that delivers an Intuitive Inbox experience designed to learn from user behavior to drastically expedite the email process.
We use Your Personal data to provide and improve the Service. By using the Crater application, you consent to the data practices described in this statement.
- Definitions
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural. For the purposes of this Privacy Policy:
- Account means a unique account created for You to access our Service or parts of our Service.
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- Application refers to Crater Email Client, the software program provided by the Company.

- Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

- Collection of Your Personal Information
In order to better provide you with products and services offered, Crater may collect Personally identifiable information, including but not limited to your:
- First and Last Name
- Mailing Address
- E-mail Address
- Phone number
If you purchase Crater's products and Services, we collect billing and credit card information. This information is used to complete the purchase and subscription transactions, however is not retained by Us for any other reason.
We do not collect any Personal information about You unless You voluntarily provide it to Us. However, You may be required to provide certain Personal information to Us when You elect to use certain products or Services. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by Us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending Us an email message; (e) submitting Your credit card or other payment information when ordering and purchasing products and Services. To wit, we will use Your information for, but not limited to, communicating with You in relation to Services and/or products You have requested from Us. - Permissions Needed to Operate and Improve our Service:
To operate, deliver, and continuously improve our Service to You, We need access to two primary types of data:
Application Data constitutes information we get directly from your email provider (typically Gmail or Outlook). Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use and Secure Data Handling requirements. Our use of information received from Microsoft APIs will adhere to the Microsoft APIs Terms of Use. This information is necessary for Us to deliver the core functionality of a standard email client, so that we can provide You with all the same features You’re used to in ‘traditional email’. This includes but is not limited to:
- Email authentication tokens (for streamlined, automatic sign-ins on the Service)
- Email content data
- Email metadata
- Email labels, folders, filters, rules, mail signatures
- Anonymous email information
Usage Data consists of data that Crater tracks and creates through Your use of the Service that will directly improve Your experience using our platform. This includes but is not limited to:
- Statistics on usage of app features
- Time spent on certain pages
- Language patterns
- Derivative data
We do not collect any Application Data or Usage Data without your express consent. However, you may be required to provide Application Data and Usage Data in order to utilize primary functions of the Crater Email Client. Outside immediate problem resolution, insights on user analytics are always aggregated and anonymized, and they are never attributed to an individual user.
- Use of Personal, Application, and Usage Information
Crater collects and uses your Personal information to operate and deliver the Services You have requested.
Crater may also use Your Personally identifiable information to inform You of other products or Services available from Crater and its partners.
The Company may use Personal Data for the following purposes:
- To provide and maintain Our Service, including to monitor the usage of Our Service.
- To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
- For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or Services You have purchased or of any other contract with Us through the Service.
- To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

- For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, acquisition, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about Our Service users is among the assets transferred.
- For analysis: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve Our Service, products, services, marketing and Your experience.
Crater extracts information from your email provider in order to build Our email client experience. The company may use Application Data for the following purposes:
- To provide and maintain our Service, including to monitor the usage of Our Service.
- For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or Services You have purchased or of any other contract with Us through the Service.

- Sharing Information with Third Parties
Crater only shares the information with third parties necessary to comply with law and reasonable business practices. We may share Your Personal information or derivative data with third parties in the following situations:
- Transfer of data to vendors in order to make the app function: In order to fulfill our business operational requirements and carry out specific services and functions, We may disclose Personal Data to various service providers, including but not limited to web hosting entities, debugging services, email and productivity service providers, survey facilitators, database management and sales/customer relationship management services, customer service providers, payment processors, and web and app analytics service providers. Nevertheless, it is important to note that solely Our email hosting providers (Google, Inc. and Microsoft, Inc.) and Our AI provider (OpenAI, Inc.) are granted access to Application Data. These aforementioned parties are obligated to adhere to our directives and shall engage in accessing, processing, or storing Personal Data strictly within the scope of their obligations to us. Crater is committed to only working with third parties who have a proven track record of reliability and who place extreme value on User security. - With Service Providers: We may share Your Personal information with Service Providers to monitor and analyze the use of our Service, and to contact You.
- For business transfers: We may share or transfer Your Personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
- With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.
- With other users: when You share Personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If You interact with other users or register through a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity. Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.

All trusted-partner third parties that Crater may share your data with are required to maintain the confidentiality of your information.
Crater may disclose Your Personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Crater or the site; (b) protect and defend the rights or property of Crater; and/or (c) act under exigent circumstances to protect the personal safety of users of Crater, or the public.
- Right to Deletion
Subject to certain exceptions set out below, on receipt of a verifiable request from You, we will:
- Delete Your personal information from Our records; and
- Direct any service providers to delete Your personal information from their records.
Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:
- Complete the transaction for which the Personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or Service requested by You, or reasonably anticipated within the context of our ongoing business relationship with You, or otherwise perform a contract between You and Us;

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. - It is essential to provide our Service: In order to support and provide key features and the overall Service, including but not limited to: Intuitive Inbox, annotations, and refining recommendation algorithms.
- For security purposes: we may transfer data to maintain our Application’s security, including, but not limited to, investigating abuse of our Application
- To comply with applicable laws: we may transfer data if required or obligated to by relevant laws, or directives from regulatory authorities
- For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
- Statement on Other Transfers, Uses, and Sales of User Data (via Google API Requirements):
In accordance with the Google API Services User Data Policy, We will not transfer, use, or sell Application data for the following reasons. This means that We will not:
- Transfer or sell Application Data to third parties like advertising platforms, data brokers, or any information resellers.
- Transfer, sell, or use Application Data to serve advertisements, including retargeting, personalized or interest-based advertisements.
- Transfer, sell, or use Application data to determine credit-worthiness or for lending purposes.
- Children Under 13

- E-Mail & Social Media Communications
As part of Our Privacy Policy, it should be noted that We maintain pages on popular social media platforms, known as "Social Media Pages." When you engage with our Social Media Pages, We may collect Personal Data that You choose to share with Us through the settings on the respective social media platform. This may include Your contact details. Moreover, the companies responsible for hosting Our Social Media Pages may provide Us with aggregated information and analytics concerning the usage of Our Social Media Pages.
Likewise, email support or feedback communications are subject to the same admission of consent for availability to accompanying personal data, however in the case of help tickets, We only store and maintain correspondence records insofar as We may help service existing/future problems. Outside immediate problem resolution, insights on user grievances are only aggregated and anonymized, and never attributed to an individual user.
- External Data Storage
We store encrypted Personal and Usage Data on servers provided by third party hosting vendors with whom we have contracted. In certain situations, we may also store subsets of encrypted Application data to provide Our Service to You in the most optimal and functional manner.
- California Consumer Privacy Act / EU GDPR
Crater respects the rights and data of users residing in the state of California. In accordance with the California Consumer Privacy Act (CCPA), users in California maintain the right to request further information from Crater on how their personal information is collected (as outlined here in this document), how we process and share this information (your emails are only used to drive machine learning insights for our Intuitive Inbox, message sorting, and communications with third-party vendors to support those functionalities), to delete their information, and to opt out of any data “sales” that may occur (at this time, Crater, does not, and has no plans to sell user information). We are in the process of securing GDPR compliance, and in the interim, citizens of and potential customers from the EU are advised not to use our products or services until this compliance is acquired and finalized.

Crater reserves the right to change this Privacy Policy from time to time.
